NETWORK TEN PTY LIMITED – COPYRIGHT INFRINGEMENT/MISLEADING AND DECEPTIVE CONDUCT

We refer to your email addressed to Sam Heard on 18 August 2002 in relation to your establishment of the Website at http://seriouslysandra.iwarp.com (“Website”). It is noted that via the Website you are offering to the public in both Australia and throughout the world the ability for the public to access information and images in relation to Sandra Sully, one of the Ten Network’s personalities. We appreciate you bringing it to our attention, however, we advise that your conduct constitutes:

1. Copyright infringement under the Copyright Act 1968 (Cth) (“Copyright Act”); and

2. Misleading and deceptive conduct under the Trade Practices Act 1974 (Cth) (“TPA”) and/or the various State and Territory Fair Trading Acts in Australia (“Fair Trading Act”).

We therefore request that the Website be removed immediately. Failure to do so and further use of information and images of Sandra Sully will result in immediate legal action by Ten.

Please confirm in writing that you will comply with this letter.
